Did you know?
If a property is transferred to one spouse in terms of a divorce order, transfer duty is generally not payable. This exemption applies regardless of the marital property regime or whether the couple is married or in a civil union.
However, if the property is transferred outside the formal divorce order, transfer duty may still be payable by the spouse acquiring the property. Every situation is different, so it’s important to obtain the appropriate legal and conveyancing advice.

However, if both parties reach agreement, the terms of a divorce settlement can provide for a different division of assets than would otherwise apply under their marital contract.
